Terms of Use
1. Scope
These Terms of Use govern the use of the mobile application "501 Darts" (the "App") provided by Wallet-X, owner Martin Bergmann, Alte Brauerei 8, 46509 Xanten, Germany (the "Provider").
2. Description of service
The App is a darts scorer with various game modes (including X01, Cricket, Count Up, Around the Clock), player profiles, statistics and an audio caller. The App works entirely offline; no server services are provided.
3. Right of use
The Provider grants you a simple, non-transferable right to use the App on the Apple devices you control in accordance with the App Store usage rules. Modifying, decompiling or redistributing the App is permitted only within the limits allowed by law.
4. No warranty / limitation of liability
The App is provided "as is". To the extent permitted by law, no warranty is given for constant availability, freedom from errors or the correctness of the calculated scores. The Provider's liability is governed by statutory provisions; for slight negligence the Provider is not liable, except in the case of injury to life, body or health, or breach of essential contractual obligations.
5. User content
Content you enter (e.g. player names, photos) is stored exclusively on your device. You are responsible for ensuring that you hold the necessary rights to any photos you use.
6. Apple as third-party beneficiary
These Terms of Use are concluded solely between you and the Provider, not with Apple. Apple is not responsible for the App or its content. However, Apple and Apple's subsidiaries are third-party beneficiaries of these terms and are entitled to enforce them against you. In the event of any defect in the App, you may notify Apple, and Apple may refund the purchase price, if any. Beyond this, Apple gives no warranty to the extent permitted by law.
7. Changes
The Provider may amend these Terms of Use with effect for the future, where this is necessary to adapt to changed functions or legal requirements.
8. Final provisions
The law of the Federal Republic of Germany applies. Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
